Terms of Business

These Terms of Business (“Terms”) govern your relationship with Indian Reservations Ltd(“we”, “our”, “us”), registered in England & Wales under company number 17317614 and trading as Trust Tonto, and apply to your access to and use of the Trust Tonto platform.

By registering an account, creating a job, submitting a quote or earning rewards, you agree to be bound by these Terms. If you do not agree, you must stop using the platform.

1. What Trust Tonto is

Trust Tonto is a performance-based marketplace that connects consumers and businesses with reputable service providers, and rewards the people who introduce them. We are an introduction and administration platform only. We are not a party to the contract for the work itself, we do not carry out the work, and we do not guarantee the outcome of any job.

2. Accounts and acceptable use

  • Consumers and individuals must be at least 18 years old to register.
  • Businesses must represent a legally registered business or a legitimately self-employed trade in their jurisdiction. We may verify credentials, registration numbers and identity before enabling listing or payment features.
  • You must keep your account details accurate and your login secure, and you are responsible for activity on your account.
  • You agree not to use the platform for unlawful, fraudulent or abusive activity, to misrepresent your business, to publish false reviews, or to upload malicious files.
  • You agree not to take a job introduced through Trust Tonto off-platform in order to avoid commission.

3. Jobs, quotes and reviews

  • A customer creates a job and sends quote requests to the businesses they shortlist. Jobs are not published to the open web.
  • A business may confirm, decline or quote for a request. A quote is an offer to the customer on the terms the business states.
  • When a customer accepts a quote, a contract is formed between the customer and that business — not with us.
  • Both parties may leave an optional comment when a job is completed. Reviews must be honest and based on genuine experience; we may remove content that is abusive, defamatory or misleading.

4. Commission, cashback and introducer rewards

  • Commission becomes due from the winning business at the moment the customer accepts the quote, before work commences.
  • Commission is calculated using the published fee table in force at that time — a percentage of the accepted quote value, subject to a minimum and maximum charge. The current figures are always shown on our fees page and may be changed by us from time to time; changes apply to quotes accepted after the change.
  • The commission is then split between us, the customer (as cashback), the introducer of the customer and the introducer of the winning business, in the proportions published on our fees and rewards pages.
  • Cashback and introducer rewards are credited to Trust Tonto wallets when the commission is settled. Rewards have no cash value until withdrawn under section 6.
  • If a job never proceeds because of a cancellation, section 5 applies.

5. Cancellations

  • Either party may abort a job. The cancelling party must give the other party a written explanation, which is recorded on the job.
  • If the business cancels after winning the work, the commission already charged stands and is not refunded.
  • If the customer cancels after the business has paid its commission, the customer is charged a cancellation fee, which is used to refund the business.
  • A customer whose job is cancelled by the business may relist the job and send fresh quote requests at no additional charge.

6. Wallets, withdrawals and reconciliation

  • Cashback and introducer rewards are held as entries in your Trust Tonto wallet ledger.
  • You may request a withdrawal once your available balance reaches the minimum withdrawal amount set by us and shown on your earnings page.
  • Withdrawals are reviewed, approved and paid by bank transfer against the account details you provide. You are responsible for the accuracy of those details.
  • We may withhold, reverse or cancel a wallet entry or withdrawal where the underlying job was cancelled, refunded, disputed or obtained fraudulently.

7. Payments and tax

  • Card payments, commission charges and cancellation fees are processed by Stripe. You agree to Stripe's terms and to provide any identity or verification information they require. Payments may be delayed or suspended where verification fails.
  • Commission charged to a business is inclusive of UK VAT at the prevailing rate where applicable.
  • Amounts paid to introducers may be inclusive of VAT depending on the VAT status you record on your account. You are responsible for keeping your VAT status accurate and for declaring your own income and tax.
  • Prices agreed between a customer and a business, and the VAT treatment of that work, are a matter between those parties.

8. Sign-up credits and promotions

Where we run a promotion — such as a credit for signing up within an advertised window — the credit is limited to one per user, is not transferable, has no cash value except through the normal withdrawal process, and is subject to the terms and timings advertised at the time. We may withdraw or vary a promotion at any time before it is claimed.

9. Early access

While Trust Tonto is in early access, payment features may run in test mode and some functionality may change. Accounts, profiles and job history created during early access carry over to launch.

10. Limitation of liability

  • The platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access or a specific volume of jobs, quotes or leads.
  • We rely on third-party infrastructure for hosting, storage, email and payments, and we are not liable for losses caused by their outages or suspensions.
  • We are not liable for the quality, timeliness, safety or legality of work agreed between a customer and a business, nor for any contract, dispute or loss arising from it.
  • Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, our total liability to you is limited to the fees we have received in relation to the job in question.

11. Termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, publish false or abusive content, fail to settle commission or cancellation fees due, or behave in a way that threatens the safety or trust of other members. You may close your account at any time; amounts already due remain payable.

12. Governing law

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
